Summary
General Motors
, LLC (GM) is recalling certain 2018-2020 Buick
Regal vehicles. In the event of a vacuum-power brake assist failure, a software error in the electronic brake control module (EBCM) may result in a loss of power brake assist. As such, these vehicles fail to conform to Federal Motor Vehicle Safety Standard No. 135, “Light vehicle brake systems.”
Remedy
Dealers will update the EBCM software, free of charge. Interim owner notification letters advising owners of the safety risk were mailed on August 19, 2022. Owner notification letters were mailed September 16, 2022. Owners may contact Buick

Chronology :
On April 28, 2022, an issue was submitted to GMโs Speak Up For Safety (SUFS) program based on an Opel investigation of a potential brake-performance issue on the 2019 model year Opel Insignia, a sister vehicle to the Buick
Regal. GM opened a formal investigation on May 6, 2022.
GMโs supplier reviewed EBCM software files and determined that a software error in a file supplied by GM could cause the hydraulic-brake boost to fail to respond to a loss of brake-vacuum pressure. Tests conducted on a Buick
Regal by GM on June 22 and June 23, 2022, showed that stopping distance following loss of vacuum brake pressure could exceed FMVSS 135 requirements by 1 to 5%.
A review of field data identified four field claims received by GM between January 17, 2019 and March 22, 2022 in which the vehicleโs invalid vacuum pressure DTC (diagnostic trouble code) was set and the hydraulic brake boost was disabled. None of these claims involved an allegation that the condition contributed to a crash, and GM is not aware of any crashes or injuries relating to this condition. On June 23, 2022, GMโs Safety Field Action Decision Authority (SFADA) decided to conduct a noncompliance recall.

F/CMVSS Noncompliance Recall N222370090 Increased Stopping Distance During Certain Brake Vacuum Loss Events Page 3 of 8 โข Ensure the programming tool is equipped with the latest software and is securely connected to the data link connector. If there is an interruption during programming, programming failure or control module damage may occur. โข Stable battery voltage is critical during programming. Any fluctuation, spiking, over voltage or loss of voltage will interrupt programming. Install a GM Authorized Programming Support Tool to maintain system voltage. Refer to www.gmdesolutions.com for further information. If not available, connect a fully charged 12 V jumper or booster pack disconnected from the AC voltage supply. DO NOT connect a battery charger. โข Follow the on-screen prompts regarding ignition power mode, but ensure that anything that drains excessive power (exterior lights, HVAC blower motor, etc) is off. โข Clear DTCs after programming is complete. Clearing powertrain DTCs will set the Inspection/Maintenance (I/M) system status indicators to NO. Important: The service technician always needs to verify that the VIN displayed in the TLC left side drop down menu and the top center window match the VIN plate of the vehicle to be programmed prior to using Service Programming System 2 (SPS2) for programming or reprogramming a module. โข For the TLC application, service technicians need to always ensure that the power mode (ignition) is โONโ before reading the VIN from the vehicleโs VIN master module and that they do not select a VIN that is already in the TLC application memory from a previous vehicle. โข If the VIN that shows up in the TLC top center window after correctly reading the VIN from the vehicle does not match the VIN plate of the vehicle, manually type in the VIN characters from the vehicle VIN plate into the TLC top center window and use these for programming or reprogramming the subject module with the correct vehicle VIN and software and/or calibrations. โข The Engine Control Module (ECM) is the master module (for VIP vehicles) that TLC reads to determine the VIN of the vehicle. If the VIN read from the vehicle by TLC does not match the VIN plate of the vehicle, the ECM also needs to be reprogrammed with the correct VIN, software and calibrations that match the vehicleโs VIN plate. โข The Body Control Module (BCM) is the master module (for GEM vehicles) that TLC reads to determine the VIN of the vehicle. If the VIN read from the vehicle by TLC does not match the VIN plate of the vehicle, the BCM also needs to be reprogrammed with the correct VIN, software and calibrations that match the vehicleโs VIN plate. Caution: Be sure the VIN selected in the drop down menu (1) is the same as the vehicle connected (2) before beginning programming. 5743643 Important: If the vehicle VIN DOES NOT match, the message below will be shown. Dealer Responsibility โ For USA & Export (USA States, Territories, and Possessions) It is a violation of Federal law for a dealer to deliver a new motor vehicle or any new or used item of motor vehicle equipment (including a tire) covered by this notification under a sale or lease until the defect or noncompliance is remedied. The US National Traffic and Motor Vehicle Safety Act provides that each vehicle that is subject to a recall of this type must be adequately repaired within a reasonable time after the customer has tendered it for repair. A failure to repair within sixty days after tender of a vehicle is prima facie evidence of failure to repair within a reasonable time. If the condition is not adequately repaired within a reasonable time, the customer may be entitled to an identical or reasonably equivalent vehicle at no charge or to a refund of the purchase price less a reasonable allowance for depreciation. To avoid having to provide these burdensome remedies, every effort must be made to promptly schedule an appointment with each customer and to repair their vehicle as soon as possible. In the recall notification letters, customers are told how to contact the US National Highway Traffic Safety Administration if the recall is not completed within a reasonable time. Dealer Responsibility โ All All new, used, GM Certified Used, courtesy transportation vehicles, dealer shuttle vehicles, etc. in dealers’ possession and subject to this recall must be held and inspected/repaired per the service procedure of this bulletin before customers take possession of these vehicles. Involved vehicles must be held and not delivered to customers, dealer-traded, released to auction, used for demonstration, or any other purpose. All GM Certified Used vehicles currently in the dealersโ inventory within the Certified Pre-Owned Inventory System (CPOIS) will be de-certified and must be held and remedied per the service procedure in this bulletin. Upon submitting an accepted/paid warranty transaction in the Global Warranty Management (GWM) system, the vehicle can be re-certified for sale within the CPOIS system, or once again be used in the CTP program. Dealers are to service all vehicles subject to this recall at no charge to customers, regardless of mileage, age of vehicle, or ownership, from this time forward. Customers who have recently purchased vehicles sold from your vehicle inventory, and for which there is no customer information indicated on the dealer listing, are to be contacted by the dealer. Arrangements are to be made to make the required correction according to the instructions contained in this bulletin. Recall follow-up cards should not be used for this purpose, since the customer may not as yet have received the notification letter. In summary, whenever a vehicle subject to this field action enters your vehicle inventory you must take the steps necessary to ensure the program correction has been made before selling the vehicle. In addition, for vehicles entering your facility for service, you are required to ensure the customer is aware of the open field action and make every reasonable effort to implement the program correction as set forth in this bulletin prior to releasing the vehicle. Dealer Reports โ For USA & Export For dealers with involved vehicles, a listing has been prepared and will be available through GM GlobalConnect Maxis Field Action Reports or sent directly to export dealers. GM CUSTOMER CARE AND AFTERSALES DCS6216 URGENT – DISTRIBUTE IMMEDIATELY Date: July 15, 2022 Subject: N222370090 – Noncompliance Recall Increased Stopping Distance During Certain Brake Vacuum Loss Events Application for Used Vehicle Working Capital Assistance Program (WCAP) Models: 2018 โ 2020 Buick Regal To: All General Motors Dealers On June 30, 2022, GM sent to all GM dealers GlobalConnect Message GCUS-3-2567 regarding Noncompliance recall N222370090. The required repair to complete this recall is not yet available. Until further instructions are received, the involved vehicles that are in dealersโ possession (new or used vehicle inventory, GM Certified Used, courtesy transportation vehicles, dealer shuttle vehicles, etc.) must be held and cannot be delivered to customers, dealer-traded, released to auction, used for demonstration purposes or put to any other use. This message is to inform dealers who have involved vehicles in their inventory that they can now apply for the used vehicle Working Capital Assistance Program (โWCAPโ) for Non-Compliance recall N222370090. Before proceeding with the application process described below, dealers must verify vehicle eligibility based on the program terms and guidelines that were provided in GM GlobalConnect Message GCUS-9-10968 dated March 10, 2021. Applications submitted on ineligible vehicles are subject to chargeback of any incentives paid to the dealer under the WCAP. Because compensation and tracking requires visibility into dealersโ inventory, dealers must also have agreed to a Dealer Data Share agreement with GM in order to receive any compensation under this program. To apply for the WCAP for Noncompliance recall N222370090, dealers must access the GM Global Warranty Management (GWM) system and submit a โZSETโ warranty transaction using the labor code provided below for each eligible vehicle. This zero dollar special transaction type is the dealerโs application for compensation and constitutes a representation from the dealer that the vehicle is eligible for WCAP assistance. Note: Acceptance of the warranty transaction does not ensure vehicle eligibility or guarantee the provision of any assistance as defined by program terms and guidelines. Labor Code Description Labor Time Trans Code 9800094 Working Capital Assistance for Non-Compliance Recall N222370090 N/A ZSET To be eligible for the WCAP, a vehicle must be in dealer inventory at the time the related field action bulletin is released. If a vehicle has been delivered, wholesaled or otherwise disposed of prior to release of the bulletin, the vehicle is not eligible for assistance. Additionally, recalled vehicles taken in on trade may be eligible for assistance if the dealer immediately reports the vehicle in used vehicle inventory via its Dealer Management System (DMS) and makes application through the GWM system. To ensure that GM is receiving daily inventory information, which is necessary to process payments and make eligibility determinations under the WCAP, the dealerโs vehicles must be properly identified in the dealershipโs DMS. A daily feed of this information is provided to GM through the Dealer Data Share (DDS) agreement. Beginning with the 1st quarter of 2019, all WCAP payments will be facilitated through the Global Warranty Management (GWM) system. For each eligible vehicle, a qualifying dealer will submit for WCAP vehicle enrollment with a โZSETโ transaction type and for reimbursement with a โZFATโ transaction type both through the GWM system. If approved, a WCAP credit for that vehicle will be issued through the GWM system similar to any other warranty credit. WCAP submission instructions and the required labor code will also be provided in the appropriate field action bulletin. Each WCAP transaction being credited will be clearly identified on the dealerโs daily credit memo. In order to receive payment, a dealer must have timely reported the vehicle in used vehicle inventory, retained the vehicle until the related field action bulletin is released, and properly applied for the WCAP payment. The vehicle must also be otherwise eligible under WCAP rules and guidelines. GM reserves the right to amend, modify, terminate, or cancel this program at any time in its sole discretion. General Motors has notified the National Highway Traffic Safety Administration (NHTSA) about an upcoming noncompliance recall that involves these vehicles. The GM recall number is N222370090. It is a violation of federal law for a dealer to deliver a new motor vehicle or any new or used item of motor vehicle equipment (including a tire) covered by this notification until the noncompliance is remedied. Certain 2018-2020 model year Buick Regal vehicles may fail to conform to S7.11 of Federal Motor Vehicle Safety Standard (FMVSS) No. 135, โLight vehicle brake systems.โ These vehicles may exceed the stopping distance prescribed by FMVSS 135, S7.11 for brake performance following loss of brake power assist. If, following the loss of brake power assist, the driver does not use additional effort to apply the brake pedal, the vehicleโs stopping distance may increase which could increase the risk of a crash. To correct this condition, dealers will reflash the software in the electronic brake control module (EBCM). Until further instructions are received, involved vehicles that are in dealersโ possession (new or used vehicle inventory, GM Certified Used, courtesy transportation vehicles, dealer shuttle vehicles, etc.) must be held and not delivered to customers, dealer-traded, released to auction, used for demonstration purposes or any other dealer use. All GM Certified Used vehicles currently in the dealersโ inventory within the Certified Pre-Owned Inventory System (CPOIS) will be de-certified. The Investigate Vehicle History (IVH) screen in the Global Warranty Management (GWM) system has been updated for this upcoming recall. This action has been taken to assist dealers with determining which vehicles are involved so they can properly respond to customer inquiries. A list of involved vehicles that have been identified as being in dealer new/used vehicle inventory is attached to this message. It is sorted by dealer Business Associate Code (BAC) for easy reference. Your dealershipโs BAC will not be listed if none of the involved vehicles are currently in your vehicle inventory. To identify involved vehicles in dealer used inventory, run an Open VIN Report or Field Action Initiation Report using Field Action Reports-GFAM within the Maxis Dealer Application in GlobalConnect. Frequently Asked Questions Document (FAQs) Attached to this message you will find a document that addresses the ten most likely questions customers may have regarding this Noncompliance Recall. Please use this information as an aid to confidently answer customer concerns. Until the recall bulletin is released, the Investigate Vehicle History (IVH) screen in the Global Warranty Management (GWM) system will display “N/A” under Release Date and “Incomplete โ Remedy not yet available” under Status. This means the required repair is not yet available and dealers should not attempt to perform any repairs. We are working to develop a remedy as quickly as possible. When a remedy is available, the recall bulletin will be released and dealers can begin repairing vehicles. END OF MESSAGE GLOBAL SAFETY FIELD INVESTIGATIONS

Involved Components : Component Name 1 : DATA FILE-ELEK BRK CONT MDL XML Component Description : Electronic Brake Control Module Software Component Part Number : 39135331, 39187211, 39187212, 39187213, 39215667, 39215668, 39215669 Supplier Identification : Component Manufacturer Name : NR Address : NR NR Country : NR Chronology : On April 28, 2022, an issue was submitted to GMโs Speak Up For Safety (SUFS) program based on an Opel investigation of a potential brake-performance issue on the 2019 model year Opel Insignia, a sister vehicle to the Buick Regal. GM opened a formal investigation on May 6, 2022. GMโs supplier reviewed EBCM software files and determined that a software error in a file supplied by GM could cause the hydraulic-brake boost to fail to respond to a loss of brake-vacuum pressure. Tests conducted on a Buick Regal by GM on June 22 and June 23, 2022, showed that stopping distance following loss of vacuum brake pressure could exceed FMVSS 135 requirements by 1 to 5%. Part 573 Safety Recall Report 22V-465 Page 3 The information contained in this report was submitted pursuant to 49 CFR ยง573 Description of Remedy : Description of Remedy Program : Dealers will reflash the software in the electronic brake control module (EBCM).
